FerryBooking24 – Terms and conditions of sale

1 – FerryBooking24

This website under the brand name FerryBooking24 is a ferry comparison and booking site, which is part of European Tourist Services, a tour operator specializing in the online sale of maritime ticketing, an intermediary for the shipping companies featured on this site.

Servizi Turistici Europei (or STE Tour Operator) is owned by Penta srl and is based in Piazza Marinai d’Italia, 12 – 57037 Portoferraio (LI) – Island of Elba – Italy. Partita IVA/C.F./Isc. Reg. Imprese CCIAA LI 00963600499 – aut. prov. Livorno 113 of 11/12/95.

Hereafter it will be referred to as FerryBooking24.

2 – BOOKINGS

By sending the reservation request, the customer is responsible for carefully checking the details of the request, as these will be faithfully reported in the ticket (car model, number of passengers, etc.) even if they are inconsistent. It is recommended to always provide at least one cell phone number, so that reservation center operators can contact the customer when needed. It will be useful for any requests for clarification, for reporting any inconsistencies before the ticket is issued (in case the issuance is done manually), and for any schedule changes after the issuance. By submitting a booking request, the customer agrees to the current booking terms and conditions of FerryBooking24, as well as of the transportation and sales conditions of the shipping companies chosen for the trip. Automatic transmission of the reservation request from this website does not imply automatic seat assignment, which will be confirmed only when the final tickets are sent.

2.1 – BOOKINGS AND UPCOMING DEPARTURES

The FerryBooking24 reservation system is a fully automated system for all the part that involves quoting, choosing rides, fares, and online payment. It is equipped to receive reservations 24 hours a day. However, ticket processing and dispatching are always supervised by the reservation center operators. For this reason, during office hours, ticket mailing operations can be very fast. However, tickets are not dispatched outside office hours. Exceptions are reservations made for upcoming departures, whose tickets will still be sent within minutes. For certain types of reservations, that are not fully automated, and in the absence of specific agreements with the customer, our operators may decide at their sole discretion not to proceed with the reservation if there are no prerequisites for sending it to the customer in a timely manner. In this case FerryBooking24 will only be responsible for refunding or reversing the payment received, retaining only any collection fees and/or commissions. Reservations involving postal or express courier shipment are not accepted by the system below a certain amount of days prudently required for shipment.

2.2 – FARES

FerryBooking24 acts as an intermediary for the shipping companies. As an intermediary, it has no authority to intervene in the rates, which are the same as those charged by the shipping companies themselves. FerryBooking24 is only entitled to charge a ticketing fee, that may be commensurate with the type of ticket, route, or shipping company booked. These issuance fees, will be visible during the booking process in the “Summary of services required” box. Shipping companies have the right to change fares without notice until the ticket is issued; subsequent to this issuance, in particularly exceptional cases, shipping companies may notify customers of fare increases (e.g., fuel surcharges).

The reservation system is set up to offer the customer the best available fares depending on the combination of passenger + vehicle in tow + any seat/cab chosen by the customer. However, the best fares or promotional offers often have limitations, especially on changes or cancellations.  Generally, changes or cancellations result in the total loss of the ticket amount on offer. In order to provide the customer with an informed choice in this regard, the reservation system provides, through a special checkbox, a display of all fares present for each ride, including higher fares but with fewer restrictions. It also provides brief information on each individual fare/ride. However, we recommend purchasing at a very competitive price the cancellation penalty insurance suggested in the quote summary (step 3 of booking).

Due to the dynamic nature of prices, regulated by shipping companies, there may be variations in fares between the quote and the actual issuing of tickets (which in some cases occurs after receipt of payment). If the payment is made at the same time as the reservation, there will be no problem of adjustment to the new rates. However, if a deferred payment method such as bank transfer, money order or other was chosen, the customer will be asked for the rate adjustment that has occurred in the meantime.

2.3 – PAYMENTS

Only after receipt of payment can tickets be issued. For this reason, if deferred payment mode is chosen, fare increases and seat exhaustion may occur between the issuance of the quote and receipt of payment. In this case, FerryBooking24 cannot be held responsible for such changes, that are beyond the control of FerryBooking24 itself. To avoid such situations, we recommend using instant payments (e.g., online credit card, PostePay, Apple Pay, Google Pay, Paypal, Scalapay, Satispay, MyBank, BancomatPay, Sofort, iDeal). Some payment methods are automatically disabled by the system if there is no technical time for their verification, so only immediate payment methods are available for upcoming departures.

Until actual payment is made, the reservation request cannot be considered a final confirmation.

For bookings with “credit card by phone” payment, customers will be contacted by a FerryBooking24 operator and must provide their card details and the required documentation. In case FerryBooking24 does not promptly contact the customer for this procedure, the customer is required to contact the FerryBooking24 reservation center to carry out this operation. If this operation is not carried out, no tickets will be issued. The longer the time elapsed between the quote and the payment, the greater the chance of changes in price and/or availability of places, for which FerryBooking24 cannot be held responsible. For reservations with payment by bank transfer or postal bulletin, the customer should send by fax or e-mail, a copy of the deposit to FerryBooking24’s bank account as indicated in the confirmation email, in order to speed up the issuance of tickets and consequently lock in price and seats. This is necessary because a transfer is actually credited to the beneficiary’s bank account usually one or more days after the payment. Changes in price or seat availability may occur during this time. In this case, the tickets will be issued as soon as possible, but shipped only after the actual crediting of the FerryBooking24 account has been confirmed.

If you buy with Scalapay you receive your order immediately and pay in 3 installments. You acknowledge that the installments will be assigned to Incremento SPV S.r.l., related parties and their assignees, and that you authorize such assignment.

3 – SHIPPING

Travel documents will be sent to the customer by e-mail (as an attachment, or via a link). If the customer chooses to receive the tickets in paper form (with varying costs depending on the destination), it is advisable to indicate a manned address during office hours, in order to avoid missed deliveries that could delay delivery.

Upon receiving the tickets, it is advisable to carefully check the contents and immediately report any inconsistency with the request made. Late reporting of inconsistencies may not allow the ticket to be changed. Possession of a ticket with inconsistent information may not allow boarding on the booked ferry. Any ticket changes required due to customer input errors will be at the charge of the customer. In this regard, only the confirmation email sent to the customer at the time of booking will be considered valid. This email contains all the data entered by the customer, which will later also be indicated on the booked tickets.

4 – USE OF TICKETS

It is recommended to arrive at the boarding point well in advance, observing the timeline indicated by the shipping companies in the email accompanying the tickets, especially during periods of high traffic flow, in particular if traveling on international routes. Any delays or missed departures may forfeit the right to boarding or any refund from the shipping company. It is also required to arrive at the boarding point with all documentation required by the shipping companies’ conditions of carriage. The customer is also required to present at boarding all appropriate identity documents to reach the selected destination (ID cards, passports, visas, etc.) for all booked passengers, including minors.

Any page printed from this website or email received, excluding tickets, does not constitute a valid document for boarding.

5 – CHANGES AND CANCELLATIONS

In the case of changes or variations of already issued tickets, if the terms of regulations of the shipping company concerned allow these changes, the customer will be required to pay the variation fees stipulated in the general conditions of carriage of that company. In addition, the customer shall pay FerryBooking24 €20.00 for each ticket change or modification for each route. Change or cancellation requests communicated by telephone will not be accepted. All requests to change or cancel bookings must be received by FerryBooking24 via email or fax.

In case of cancellation of already issued tickets, the customer will be required to pay cancellation penalties according to the general conditions of carriage of the booked shipping company.  Any partial refunds will always be subject to FerryBooking24’s variation fees in the amount of €20.00 per ticket per route. Reservation fees and shipping costs will not be refunded under any circumstances. We recommend taking out cancellation penalty insurance at the same time as booking.

6 – REFUNDS

Amounts charged and subsequently credited back to the customer’s credit card by FerryBooking24 may not be made immediately available by the card provider. In such cases, only the credit card holder, as the sole interlocutor with his or her credit institution, may request the operator to restore the amount to his or her credit account in advance. Credit recovery times may vary depending on the credit institution.

In case of payment exceeding the amount due for the reservation, made by bank transfer or through another offline means of payment, FerryBooking24 will refund the difference.

In case of cancellation or change of tickets, FerryBooking24 will refund to the customer the amounts due after receiving the refund from the Maritime Company concerned. These refunds usually have monthly frequencies.

Not using tickets that have already been issued, for any reason, will not lead to an automatic refund of the tickets. Refund, if provided or granted, will be subject to verification by the shipping company concerned. If the ticket has not been used on the reserved ride or on another ride, it will be verified. Such verification could result in delays in the refund process and waits in the range of 60 days.

7 – JURISDICTION

Any legal disputes shall be governed by Italian law and the Court of the Livorno District shall have exclusive jurisdiction. In the case of the passenger, who holds the status of consumer under current Italian law, the court of residence or domicile of the passenger, if domiciled or resident in Italy, shall have exclusive jurisdiction.
